LibreAte Terms of Service

Effective date: 12 October 2026

These Terms of Service ("Terms") govern your access to and use of the LibreAte mobile application (the "App"), operated by Barron Si (ABN: 73 321 151 863) ("LibreAte", "we", "us", or "our"). By creating an account or otherwise using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 18 years old to use LibreAte. By using the App, you represent that you meet this requirement and that all information you provide is accurate.

2. Nature of the Service — Not Medical Advice

LibreAte is a community crowdsourcing tool. It is not medical advice.

Reviews, safe dish suggestions, allergy tags, and any other content on the App reflect the personal experiences and opinions of individual users. Allergy sensitivity, ingredients, and cross-contamination risk can vary between individuals and between visits to the same restaurant, even where a dish has previously been reported as safe. You must always confirm allergy safety directly with restaurant staff before ordering or consuming any food, regardless of what is shown on the App. LibreAte does not verify the accuracy of user-submitted content and is not responsible for any allergic reaction, illness, or other harm arising from reliance on content within the App. The EpiPen Tracker feature is a personal reminder tool only, and is not a substitute for professional medical advice regarding your allergy management plan. This is also set out in the Safety Disclaimer you agreed to when creating your account.

3. Your Account

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

• You must provide accurate information when creating your account and keep it up to date.

• You may delete your account at any time via Account & Data in App Settings, with the option to fully delete your data or to anonymise your account while retaining your past reviews for the benefit of the community (displayed as posted by "Deleted User").

4. User Content

4.1 Your responsibility for content

You are solely responsible for any reviews, comments, photos, or other content you submit to the App ("User Content"). By submitting User Content, you confirm that it is accurate to the best of your knowledge, that you have the right to share it, and that it does not violate these Terms or any applicable law.

4.2 Licence to LibreAte

By submitting User Content, you grant LibreAte a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, reproduce, display, and distribute that content within the App, for as long as your content remains on the App, for the purpose of operating and promoting the service.

4.3 Prohibited content and conduct

You must not use the App to:

• Post false, misleading, or deliberately inaccurate allergy or safety information.

• Post content that is defamatory, harassing, hateful, obscene, or otherwise unlawful.

• Impersonate any person or business, including falsely claiming ownership of a business listing.

• Post content that infringes the intellectual property or privacy rights of others.

• Attempt to interfere with, disrupt, or gain unauthorised access to the App or its systems.

We have zero tolerance for objectionable content or abusive behaviour. Such content is removed and the account responsible is closed.

We reserve the right to remove any User Content and to suspend or terminate accounts that violate these Terms, at our discretion.

5. Business Listings and Claims

Restaurant and business information displayed on the App is primarily sourced from the Google Places API and may not always be complete or up to date. Business owners or authorised representatives may claim a listing through our verification process. A claimed and verified listing allows the claimant to publicly reply to reviews on that listing. LibreAte does not guarantee the accuracy of claims and reserves the right to revoke a claim if we determine it was made fraudulently or in error.

6. Subscriptions and Payments

LibreAte offers an optional paid subscription ("Premium") providing additional features. Premium is available as a monthly or annual auto-renewing subscription. The current price and billing period are displayed on the purchase screen within the App before you confirm.

Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Your subscription automatically renews at the then-current price unless you cancel at least 24 hours before the end of the current billing period. Your account is charged for renewal within 24 hours prior to the end of the current period.

You can manage or cancel your subscription at any time through your Apple ID account settings or Google Play subscription settings. Deleting the App does not cancel your subscription. Where a free trial is offered, any unused portion is forfeited if you purchase a subscription before the trial ends.

All purchases are processed by the applicable app store and are subject to that store's terms and refund policies. LibreAte does not process payments directly and cannot issue refunds; refund requests must be made to Apple or Google.

Subscriptions are managed through RevenueCat, a third-party subscription management provider.

7. Intellectual Property

The App, including its design, branding, and underlying software, is owned by LibreAte and protected by intellectual property laws. Except for User Content, you may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

8. Third-Party Services

The App relies on third-party services, including but not limited to Supabase (hosting and authentication), the Google Places API, Resend (transactional email), and RevenueCat (subscription management). We are not responsible for the availability, accuracy, or performance of these third-party services, which are governed by their own terms and privacy policies.

9. Apple

You acknowledge that these Terms are between you and LibreAte only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. Apple has no obligation to provide any maintenance or support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund any applicable purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, or claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defence, settlement or discharge of any third-party claim that the App infringes that third party's intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT USER-SUBMITTED ALLERGY OR SAFETY INFORMATION IS ACCURATE, COMPLETE, OR CURRENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIBREATE AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, HEALTH, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO ANY ALLERGIC REACTION OR OTHER HEALTH CONSEQUENCE ARISING FROM RELIANCE ON CONTENT WITHIN THE APP. NOTHING IN THESE TERMS EXCLUDES ANY GUARANTEE, WARRANTY, OR OTHER RIGHT WHICH CANNOT BE LAWFULLY EXCLUDED UNDER THE AUSTRALIAN CONSUMER LAW.

12. Indemnity

You agree to indemnify and hold harmless LibreAte and its operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the App, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms. You may stop using the App and delete your account at any time, as described in section 3.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles. You submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.
